J. Kershaw Spong
Mr. Spong's practice involves commercial and residential foreclosure, lender liability, commercial litigation, and workouts. In the commercial area, the types of foreclosures handled include a golf course, a stock yard, a performing theater, commercial office buildings, development tracts, and hotels. In the residential area, Mr. Spong recently litigated the enforceability of arbitration agreements regarding consumer claims against the lender, and successfully argued a mortgage priority claim in the South Carolina Supreme Court on behalf of a lender.
In the construction area, Mr. Spong's recent cases involve the scope of liability on construction bonds, including bid bonds submitted by contractors; Mr. Spong also was involved in a recent nationally reported case addressing the scope of liability of architects arising out of administrative duties in relation to subcontractors.
Mr. Spong also serves as the Chapter 12 Bankruptcy Trustee for the district of South Carolina.
Mr. Spong previously served as counsel to the United States Senate Judiciary Committee, United States Senate Labor and Human Resources Committee and Legislative Director to United States Senator Strom Thurmond (R-SC). He enjoys being active in the community and has served on the Board of Directors and as President of the South Carolina Philharmonic Orchestra.
