The majority of Mr. Bell's litigation practice involves class action defense and insurance disputes. In addition to these areas of concentration, Mr. Bell’s general litigation practice has involved a wide array of trial and appellate matters for the firm's clients, including collapsed bridges, collapsed TV towers, construction defects, product defects, computer software design failures, unfair competition, Sec. 1983 claims, wrongful termination, copyright infringement, defamation, employment discrimination, medical malpractice, and unfair trade practices.
Mr. Bell's insurance practice centers around two distinct areas of concentration, life insurance and commercial liability / property insurance. Mr. Bell's work with the life insurance industry is an extension of his experience in the legal department of a life insurer, and it has involved representation of life insurers in virtually every aspect of the business: claims, servicing, market conduct, bad faith, fraud, accidental death, suicide, rescission, unfair discrimination, regulatory examinations, compliance, guaranty fund claims, unfair competition, defamation, trade secrets, commission disputes, failure of interest sensitive products, agent misconduct, licensing, and disciplinary proceedings. The insurance products involved have ranged from home service policies to complex interest sensitive policies. The legal work has involved preventive advice, training, individual litigation, and class actions. In addition to direct handling of matters in South Carolina, Mr. Bell also works with insurers to oversee litigation in other jurisdictions.
Mr. Bell's second area of insurance concentration involves representation of policyholders in claims for coverage pursuant to general liability, commercial property, and various professional errors and omissions policies. While the firm's clients in these matters tend to be corporate policyholders who are also being represented by the firm in the underlying litigation, the firm actively pursues insurance coverage for clients on a standalone basis when the policyholder is represented by other counsel in the underlying matter. The firm has successfully pursued insurance coverage litigation for a variety of underlying claims, including television tower collapse, construction defects, wrongful death, project delays, negligent supervision, agent misconduct, failure to advise, false imprisonment, and improper third party administration.
