Robinson McFadden has a substantial and diverse commercial finance and transactions practice. Robinson McFadden regularly represents lenders and borrowers in all types of commercial transactions. In addition to its significant representation of secured lenders, the Firm represents many different types of borrowers: real estate developers, mortgage lenders, and corporations ranging from gourmet food distribution to specialty concrete products. The Firm's secured lending practice involves asset based financing, acquisition and start-up financing and many different types of government guaranteed financing under various USDA and SBA programs. The Firm serves as counsel to both local and national banks and asset based lending institutions. The commercial finance practice has closed loans in the thousands to the millions of dollars range in such industries as movie theatres, concrete plants, hotels, timber plants and everything in between. In combination with our firm's other practice groups, the Firm is able to represent borrowers and lenders from underwriting through closing, and then to payoff; or, sometimes unfortunately, workout, foreclosure or bankruptcy. Through Meritas, our attorneys are able to effectively and efficiently manage complex transactions involving multiple jurisdictions.

Most recently, the Firm has:

  • Represented the exclusive real estate developer for a movie theatre chain in developing, building and selling at least six (6) megaplex theatres with an average investment of $10-15 million per theatre;
  • Represented a secured lender in the financing of four (4) different acquisitions by a corporate borrower with collateral in five (5) different states;
  • Represented an economic development lender in loans to at least ten (10) different start-up companies throughout South Carolina, with loans ranging generally from $1 million to $5 million;
  • Worked with a secured lender regarding compliance with USDA Business and Industry Lending program and the SBA 7(a) and MicroLoan programs;
  • Represented secured lenders and borrowers in SBA 504 loans;
  • Represented a secured lender in the financing of a commercial loan by a corporate borrower, secured by collateral in three (3) states, to enable the corporate borrower to construct wastewater treatment equipment for nuclear plants.
